The US House of Representatives voted 417-3 to pass H.R. 9340, the Ratepayer Protection Act, which would make large data centers pay for the grid upgrades their electricity demand requires. The bill amends the Public Utility Regulatory Policies Act of 1978.
Under the text, customers with loads of 100 megawatts or more would pay "the full, incremental cost of any generation, transmission, or distribution upgrade necessary to serve the load" — including in the event that the customer terminates its contract or otherwise stops buying electricity from the utility.
The measure is not self-executing. Each state regulatory authority and each non-regulated electric utility would have to consider adopting the federal standard within two years of the law's passage, and states would retain the final word. It still has to clear the Senate and be signed by the president. One wrinkle: temporary data-center bans and moratoriums could expire before state regulators finish deliberating.
The bill effectively codifies President Donald Trump's July 2026 "Ratepayer Protection Pledge," in which AI hyperscalers, utilities and state governors committed to paying their own way on electricity. It grew out of utility-bill shocks that residents and small businesses attributed to data-center demand — a grievance that has driven local opposition to new projects across the country.
Some states are already ahead. Oregon's 2025 POWER Act binds developments above 20 megawatts to a cost-share, and is reported to have raised data-center electricity bills by about 30 percent while cutting residential costs by 1.3 percent. In Virginia, the State Corporation Commission has required data centers to pay for all necessary transmission infrastructure since July 2026.
Why it matters: the electricity bill for the AI build-out is turning from an engineering footnote into national politics, with press reports putting big-tech data-center spending for 2026 in the hundreds of billions of dollars. Placing the incremental grid cost on operators shifts who pays for that expansion — and could change where, and whether, the next wave of capacity gets built.
