Disney+ is rolling out a revised user agreement to customers in Germany that explicitly reserves the right to show advertising before and after content playback in all paid subscription tiers — including Standard and Premium, which were previously marketed as ad-free.

The change, communicated via email to subscribers, was described by Disney as a "clarification" of existing terms. Disney's help center states that Standard and Premium tiers "may contain limited advertising content, advertising before or after content playback, clips and trailers for Disney content, products and services, as well as content with branding or sponsorship." Live content and special events may contain ad breaks regardless of tier.

The key distinction Disney maintains: mid-roll ad interruptions during a film or series remain exclusive to the cheapest "Standard with Ads" tier. Standard and Premium subscribers will see ads before and after content, but not during it.

The timing may be connected to ESPN's integration into Disney+ in Europe since April 2026. Linear ESPN channels and replays can carry advertising independent of the subscription tier, which creates pressure to normalize ad presence across the platform.

The move adds to growing consumer frustration with Disney+ in Germany. A patent dispute with InterDigital previously stripped the Premium tier of HDR and temporarily 4K resolution, prompting Disney to offer affected users a special cancellation right. The Premium tier, the most expensive option, has progressively become less attractive to subscribers.

While advertising in "ad-free" tiers was technically permitted under previous terms through UI placement, product placement, and sponsorship, the explicit addition of pre-roll and post-roll ads represents a meaningful expansion of what Disney considers acceptable in its highest-priced subscriptions.
